Imagine facing a daily fine of RM20,000 – a sum that could quickly spiral out of control – all because of a refusal to divide assets. This is the reality for a 75-year-old man in Kuala Lumpur, as ruled by the High Court. The case centers around a judicial separation and the division of matrimonial assets, a process that has now placed him in a precarious financial and legal position.
On December 23, 2025, the High Court issued a stern warning: comply with the order to split his assets, or face serious consequences. The court's decision stems from a breach of a post-trial order, where the husband, identified as PAI, failed to adhere to the directive to equally divide his assets with his wife, HAI, aged 73. The judge, Justice Sumathi Murugiah, found the husband in contempt of court.
The heart of the matter? A marriage that spanned decades, now ending in a complex legal battle over a substantial fortune. The assets in question, both movable and immovable, are estimated to be worth approximately RM60 million. The initial ruling, delivered on November 24, 2024, by Justice Evrol Mariette Peters (now a Court of Appeal judge), mandated an equal division of these assets. The court has given the husband 30 days to comply with the original order.
Under the post-trial order, both parties were required to obtain joint valuations of the matrimonial assets. When this didn't happen, the court stepped in with a consequential order on February 25, instructing the husband to cover the valuer's fees. This is where the defiance began, leading to the current predicament.
But here's where it gets controversial: the wife also sought damages from a 38-year-old woman, named as a co-respondent, for her role in the marriage's breakdown. The court ordered the co-respondent to pay HAI RM200,000 in damages. The husband denied cheating on his wife, and claimed to be suffering from erectile dysfunction. The wife claimed that in September 2022, the husband confessed to an adulterous relationship with his mistress. A month later, HAI filed for judicial separation, seeking spousal maintenance and half the value of all marital assets.
And this is the part most people miss... The original trial judge, Justice Peters, highlighted the wife's significant contributions and sacrifices throughout the marriage, supporting her husband's professional and business success. This context is crucial in understanding the court's stance.
